Defense Says Sam Bankman-Fried May Not Testify Without ADHD Medication

Sam Bankman-Fried’s lawyers sent a letter to a federal judge on Sunday requesting to allow attention deficit hyperactivity disorder (ADHD) medication, he can’t focus on the lawsuit without it. The defense has growing concerns that Sam Bankman-Fried may not testify without a 12-hour extended-release 20 mg dose before moving him to the courthouse for trial.

Sam Bankman-Fried Can’t Testify Without Medication

According to a court filing on October 15, attorneys for Sam Bankman-Fried submitted a letter to Judge Lewis A. Kaplan seeking his prescribed dose of ADHD medication Adderall during trial hours. Lawyers said Sam Bankman-Fried is not able to focus without his prescribed medication. The lawyers have discussed it with the Court and Government, but they showed less effort to address the issue.

“The defense has a growing concern that because of Mr. Bankman-Fried’s lack of access to Adderall he has not been able to concentrate at the level he ordinarily would and that he will not be able to meaningfully participate in the presentation of the defense case.”

The defense asserts they have received no response to numerous emails and voice messages while attempting to resolve the issue with the BOP. As the trial resumes on October 16, SBF will need a 12-hour extended-release 20 mg dose of Adderall. However, there is no way of knowing currently whether the extended-release dose is effective for Sam Bankman-Fried.

Alternatively, the Court can issue an order permitting Sam Bankman-Fried to take his prescribed Adderall at the courthouse on trial days.

Moreover, the defense requested the court to adjourn the trial for a day on October 17. This will give the defense an extra day to resolve the issue while giving attorneys more time to prepare for trial.
