Attorney Deaton believes that the outcome of the Ripple case may be heavily influenced by the SEC’s legal battle with Coinbase. In October, Coinbase filed a motion to dismiss the SEC’s charges, challenging the classification of the traded crypto assets as investment contracts and questioning the SEC’s authority to regulate the crypto industry. The Ripple lawsuit, currently in the remedies stage, is scheduled to proceed in February. The final judgment will determine the SEC’s next course of action, whether to settle with Ripple or contest the summary judgment in the Second Circuit.
