The U.S SEC lawsuit against Ripple is getting intense as the watchdog is still shielding its claim over the Hinman speech and other motions. However, the court has resolved a number of disputes while some still remain unresolved.
Attorney James Filan shared updates related to the motions pending and the deadline for filing them. In the document, he highlighted motions for summary judgment.
Filan mentioned that the motion for Summary Judgement and statements over undisputed facts must be submitted by September 13, 2022. Meanwhile, the last date to file oppositions to it will be October 18, 2022. He added that 15 November will be the deadline to file replies to it.
This will bring an end to the briefing part. Both parties will then have to wait for District Judge Torres’s final verdict over the motions. Filan added that July to mid August will be a very busy time for them. However, the lawsuit will make some progress in some areas while some claims will take some more time than expected.
The attorney said that he will stick to his earlier predictions over Judge’s decisions on Expert Motions and the Summary Judgment motions. He mentioned that a decision over both motions will come at the same time. Filan expects that the date would be around March 31, 2022.
Meanwhile, he highlighted that he has no clue about the resolution of Hinman’s email dispute. However, Filan added that he believed that a decision can be formed over this dispute while the summary judgment motions remain unresolved. As the court granted SEC to file a reply to defend its claims, he is no longer as sure as he was before.
Filan termed July 26, 2022, as the next big date. The Commission’s objections will be due by this time. While Ripple and the defendants will be filing their response to it by August 9, 2022.
