Montenegro Court Denies Appeal By Do Kwon and Han Chang-joon

The Higher Court in Podgorica, Montenegro denied the appeals of the Basic State Prosecutor’s Office and the defense attorneys of Do Kwon and Han Chang-joon against the verdict of the Basic Court as ‘unfounded’, reported local news outlets on November 16.

“The Council of the Higher Court in Podgorica indicated that the first-instance court correctly and completely determined the factual situation, that it correctly applied the Criminal Code of Montenegro, as well as that it determined and evaluated all the circumstances that have an influence on the choice of the criminal sanction and its amount,” as per a statement by the court.

The higher court asserts the basic court has carefully examined the gravity of the committed crime and the personality of the defendants as perpetrators.

Extradition to South Korea

In June, Goran Rodić, the lawyer representing Do Kwon and Han Chang-joon, said extradition proceedings are set to start soon. However, they will first focus on filing a complaint against the detention.

With the higher court rejected all appeals, the executives are likely to be extradited to South Korea. Meanwhile, a Montenegro High Court is also looking to extradite both South Korean citizens to their country as the court looks to expedite the extradition proceedings.
