The subpoena, viewed as an ‘atypical and illegal’ litigation by many legal experts, has set off discussions across the broader industry.
Notably, Federal Supreme Court Minister Alexandre de Moraes cracked down on the social media platform X in Brazil earlier this month. He threatened to ban the X platform in the country if Musk failed to show.
Elon Musk Says Brazil Judge Moraes Continue To Break Laws
In a post on X dated August 29, Elon Musk highlighted Moraes, stating, “This ‘judge’ has repeatedly broken the laws he has sworn to uphold.” Musk’s statement comes against the backdrop of a subpoena issued by the Federal Supreme Court (Supremo Tribunal Federal).
The summons orbits around “IMEDIATA SUSPENSÃO DAS ATIVIDADES DA REDE SOCIAL “X” (antigo Twitter), meaning immediate suspension of the activities of social network ‘X,’ formerly Twitter. However, it’s worth noting that the Federal Supreme Court itself used X to notify Musk of the summons, which garnered ironic comments across the social media platform.
Further, the Tesla & SpaceX CEO replied to the summons with a picture of the Brazil Judge in jail, stating, “One day, this picture of you in prison will be real. Mark my words.”
On the other hand, legal experts like Andre Marsiglia, a constitutional lawyer and freedom of expression expert, deemed Moraes’ subpoena to Elon Musk via X as ‘atypical and illegal.’
Earlier this month, Judge Alexandre de Moraes threatened X’s legal representative in Brazil with arrest if the organization did not comply with censorship orders. X operations in Brazil were promptly shut down, the team revealed in an official post earlier this month. However, the app’s service was available for users.

Meanwhile, in another post on X today, Elon Musk slammed the New York Times, stating, “NYT is woke Pravda.” This statement cites a report wherein the NYT called Brazil’s crackdown on X “one of the biggest tests yet for Mr. Musk’s efforts to mold X to his personal ideology.” The American entrepreneur has notably rebranded X as a free speech platform, a stark contrast to NYT’s reports.
Also, it’s worth mentioning that Pravda was the official newspaper of the Soviet Union, famous for its state-controlled propaganda and lack of independent journalism.
