XRP Lawsuit: Attorney Lists Unresolved Issues Ahead Of Summary Judgment

Attorney James Filan informed that the public and redacted versions of these replies are due December 5, 2022 in the XRP lawsuit.

U.S. Securities and Exchange Commission (SEC) and Ripple defendants have begun to file their replies to the Motions for Summary Judgment oppositions. These replies will be filed under seal. Meanwhile, Attorney has listed the significant outstanding matters in the XRP lawsuit.

XRP lawsuit to see Hinman docs soon?

Attorney James Filan informed that the public and redacted versions of these replies are due December 5, 2022. However, it is possible to see these filings sooner in the XRP lawsuit.

In a long post, attorney mentioned that it is difficult to see references to and from the Hinman documents in the replies. It is believed that the commission will possibly redact those references. He claimed that Judge Torres would be ruling on the sealing issues around January 9, 2022.

Filan mentioned that there are three major issues pending in the XRP lawsuit. First is the Summary judgment motion. The second is a decision over expert challenges. However, the most important unresolved issue is sealing the Hinmand docs and expert reports.

 Which docs will be revealed?

However, Judge Torres’s decision on the Summary Judgment Motions will amplify what will be revealed ahead. Whatever document the judge relies on that document will be considered as the “judicial document,”. It will be disclosed later.

Coingape reported that Filan dropped an updated schedule of the XRP lawsuit. It mentioned that conference redactions are due by December 2. While redacted replies are due by December 12, 2022.

Filan further added that Judge might draft her summary judgment ruling. After this will be able to identify any of the sealed documents that she relied on.

He expects that there wouldn’t be a separate ruling on the sealing of the expert memos and Hinman docs. It is expected that Judge would announce a decision over everything together. All will be out in one big written ruling.
