US SEC Schedules Meeting to Consider New Rules for Crypto Investment Contracts

Highlights

  • US SEC announces open meeting to consider new rules for crypto investment contracts.
  • This aligns with Chair Paul Atkins’ Regulation Crypto Assets or safe harbor proposal.
  • SEC and CFTC consider pushing rules as Clarity Act faces delay in the Senate.

The U.S. Securities and Exchange Commission (SEC) is holding an open meeting on Friday to consider proposing new rules for a tailored offering regime covering crypto investment contracts. This will push discussions forward on Paul Atkins’ vision for Reg Crypto, or Regulation Crypto Assets.

US SEC Open Meeting to Consider New Crypto Investment Rules

The US SEC has scheduled an open meeting to discuss whether to issue a release proposing new rules to establish a tailored offering regime for crypto investment contracts, according to the SEC’s meetings calendar.

This is aligned with Chair Paul Atkins’ Regulation Crypto Assets or safe harbor proposal that includes crypto startups’ registration exemption, fundraising exemption, and investment contract exemption.

This meeting will begin at 10:00 AM ET and is open to the public, with visitors subjected to security checks. Also, the meeting will be open to the public via webcast on the Commission’s website at the scheduled time.

The meeting is scheduled by the SEC Division of Corporation Finance. The staff members mentioned to attend the meeting are Jim Moloney, Sebastian Gomez Abero, Valian Afshar, Patrick Faller, John Fieldsend, and Irene Paik.

If advanced, it could provide a new regulatory framework for certain crypto asset issuances that differs from traditional securities offerings. The SEC will further push for tokenization and other proposed crypto regulations.

Notably, the SEC included three proposed crypto rule changes in its regulatory agenda for this year. These focus on crypto asset regulatory framework, crypto broker-dealers, and crypto structure amendments

Brett W. Redfearn, President of Securitize, said “No more waiting there for Congress to pass the Clarity Act! It’s time for the agencies to act.

Regulator Push for Crypto Rules amid Clarity Act Delay

This comes as the Clarity Act faces a delay in the Senate and failed to pass before the August recess. The SEC and CFTC expressed readiness to come up with their crypto regulation to ensure American leadership in the global crypto market.

SEC Chair Paul Atkins recently said, “We’re ready, willing and able to come out with rules that address the same issues in the Clarity Act and other aspects of the crypto market.”

Meanwhile, Senate Majority Leader John Thune filed cloture on the Clarity Act and queued up voting on the crypto bill in mid-September when the Senate returns to session.

As regulatory boundaries continue to shift under the SEC, retail traders can mitigate risks by using the best US crypto exchanges that are fully compliant with federal oversight.
